Rental Terms and Conditions

Lofoten Car Hire AS, Vendalsjorden 28, Bøstad, company registration no. 933 260 658 VAT registered, operates a car rental service where both businesses and consumers may rent vehicles for mutual benefit by booking online and collecting/returning at Leknes Airport or another agreed location.

1. General

These terms apply to rentals and services from www.LofotenCarHire.no to businesses and consumers. The terms, together with your booking, constitute the entire agreement for the purchase.

The Lessor reserves the right to reject bookings or refuse handover where there is an objective reason, including (without limitation) missing identification, lack of a valid driving licence, missing payment authorisation/security deposit, suspected misuse, breach of these terms, or circumstances that may involve a safety risk.

2. Definitions

  • Lessor / Seller: Lofoten Car Hire AS, referred to as we, us, the lessor, or Lofoten Car Hire AS.

  • Renter / Customer: The person specified as the renter or buyer in the booking, referred to as the renter, customer, you, your.

  • Rental Items: Vehicles, equipment, accessories, and any other items rented out on LofotenCarHire.no.

  • Delivery Method / Service Points: Collection or return at Leknes Airport or a location agreed at the time of purchase.

  • Approved Driver: A person registered and approved by the Lessor in the booking/handover and who meets the requirements regarding age, driving licence and payment.

  • Unauthorised Driver: Any person operating the vehicle without being registered/approved as a driver by the Lessor.

3. Payment, Security Deposit and Prices

Payment is made online by Visa or Mastercard through our payment provider DIBS, which meets the strictest security requirements. The renter pays at the time of booking, and the rental agreement is deemed concluded. Lofoten Car Hire follows standard rental practice and also reserves a security deposit as specified in the booking confirmation at the time of booking. This reservation secures the company in the event the customer returns the rental item late, damages it, or fails to return it at all. Failure to return will be reported to the police. The amount of the security deposit varies by selected equipment and is stated in your booking confirmation. Lofoten Car Hire is entitled to use the security deposit to cover rent and other costs mentioned above and/or any recourse claims, cf. section 5 below.

All prices include VAT unless otherwise specified. The total purchase cost will be displayed before booking and includes all direct costs associated with the rental or purchase. Ferry charges, parking fees, tolls, fines or other costs incurred by the user during the rental period will be charged to the customer by Lofoten Car Hire. If there have been significant pricing errors on Lofoten Car Hire’s website, Lofoten Car Hire may unilaterally change, delete or reject bookings even after the customer has received a booking confirmation or similar. However, such errors must be corrected and the customer informed within a reasonable time after the error is discovered.

Vehicles are always delivered with a full tank of fuel and must be returned with a full tank. Failure to comply will result in a deduction from the security deposit for missing fuel, plus a fee of NOK 500.

The Lessor may post-charge and/or charge the payment card for costs arising in connection with the rental relationship, including (without limitation) damages, missing items, late return, tolls, parking fees, charges, fines, administrative costs and other claims arising under these terms.

In the event of late payment of an invoice (where invoicing is used), statutory late payment interest and collection costs may accrue in accordance with applicable law.

Mileage

The rental includes unlimited mileage (no mileage restriction).

Tolls, parking, charges and delayed reporting

Tolls, parking fees, fines, charges and other public/private outlays may be registered and post-charged at a later date. There may be a delay from when the event occurs until the Lessor receives the underlying data. The renter accepts that charging/deductions may take place some time after the rental period has ended.

Upon post-charging, the following will be charged:

  • The actual amount (tolls/parking/charge/fine/outlay), and

  • An administrative fee per case/event: NOK 500 + 10% of the underlying amount (calculated on the principal claim/outlay, excluding the administrative fee).

Full Insurance (reduction of excess)

The renter may purchase full insurance which reduces the excess payable in the event of damage.

Price: NOK 750 per day per vehicle

Full insurance does not cover:

  • Gross negligence

  • Incorrect fuel

  • Loss of or damage to keys

  • Smoking or interior damage

  • Driving outside the permitted geographic area

  • Damage to tyres, wheels and glass

4. Condition of the Rental Items

Lofoten Car Hire undertakes to deliver rental items of high quality in operational condition. Lofoten Car Hire has its own routines to inspect and maintain rental items before and after rental. You are responsible for all damage to or loss of equipment during the rental period. Exceptions may apply if the damage or loss is due to technical faults or defects. The renter is therefore obliged to inspect the rental item prior to use and contact Lofoten Car Hire if the rental item is not in the expected condition.

The renter is obliged to familiarise themselves with and follow the Lessor’s instructions, including any restrictions related to use, coverage area, winter conditions, and warning lights/error messages. If a warning light/error message indicates a risk of damage, the renter must stop further driving and contact the Lessor immediately.

5. Damage

If there is damage to the vehicle before it is used, this must be documented and reported to Lofoten Car Hire before the item is used. Failure to do so may result in you being held liable for the damage.

All damage, technical faults or accidents occurring during the rental period must be reported to Lofoten Car Hire immediately. We will then do our best to assist the renter. Damage must be reported to Post@lofotenCarHire.no immediately. This also applies in the event of theft.

The vehicle is insured with an excess of NOK 10,000. This amount is the renter’s responsibility from the start of the rental period. In the event of damage to the vehicle, this amount will be charged to the customer. In the event of recourse from the insurer or any other reduction in settlement, the customer bears full financial responsibility. By entering into this rental agreement, you as the customer accept that it is your financial obligation towards Lofoten Car Hire to compensate for damaged property, third-party property damage, compensation, indemnification, or any other form of reimbursement.

Lofoten Car Hire does not accept responsibility for misuse of the vehicle or other forms of illegal activity. You, as the customer, undertake to comply with all Norwegian laws when entering into this rental agreement. Lofoten Car Hire assumes no legal or financial liability related to the use of the vehicle or its association with the vehicle on behalf of the renter. The rented product is insured in accordance with Norwegian legislation, and this constitutes the full legal responsibility assumed by Lofoten Car Hire.

If damage occurs due to misuse, intent, or negligence, Lofoten Car Hire may use the reserved security deposit and, if necessary, charge additional outstanding amounts to cover the costs of repair, service, or replacement of damaged property. This also applies if the equipment is returned in worse condition or dirtier than normal.

We always strive to provide the best advice and tips for using the rental item, but we are not responsible for performance, or for direct or indirect damages or losses resulting from use of the rental item, delays or faults with the rental item.

The customer is legally responsible for ensuring that the correct type of fuel is used when refuelling the vehicle. Any damage resulting from incorrect refuelling will be the customer’s financial responsibility, including repair costs and associated fees. Failure to comply with this requirement may result in additional costs and penalties. The customer must exercise care and thoroughness when refuelling to avoid such liabilities.

Smoking is not permitted in our vehicles. Breach of this policy will result in fees and/or cost recovery in accordance with these terms and the fee schedule.

Incident and claims procedure (accident/theft/damage)

In the event of an accident, damage, theft or other incident that may give rise to a claim, the renter must: (i) stop and secure the area, (ii) mitigate loss, (iii) notify the Lessor immediately, and (iv) complete a written incident description and assist with documentation (photos, witnesses, time, location, registration numbers and other relevant information).

Where the situation requires it (including in the event of personal injury, disagreement about the course of events, unknown counterparty, theft, vandalism or significant damage), the renter must contact the police and obtain a police report/case number.

The renter may not enter into settlements, provide admissions, or accept liability on behalf of the Lessor without the Lessor’s explicit consent.

Repairs or workshop services must not be initiated without the Lessor’s prior approval, unless strictly necessary for safety reasons or to prevent material consequential damage.

Roadside assistance and replacement vehicle in the event of technical fault

In the event of a technical fault not caused by the renter, the Lessor will provide roadside assistance and, where applicable, a replacement vehicle within the geographic area defined as Tromsø–Lofoten, including:

  • Tromsø municipality

  • Senja

  • Vesterålen

  • All of Lofoten (Svolvær to Å)

Within this area, necessary assistance, transport and any replacement vehicle are covered by the Lessor.

If the vehicle is outside this area when the fault occurs, the renter must cover:

  • Transport of the vehicle back to the handover location

  • All costs of roadside assistance, recovery and logistics outside the coverage area

Tyres, wheels, glass and other vehicle damage

The following damage is considered the renter’s responsibility if additional insurance has not been purchased:

  • Puncture or damaged tyre

  • Wheel damage

  • Stone chips to windscreen and other glass damage

  • Damage to bodywork, mirrors, undercarriage, drivetrain or engine

  • Damage resulting from incorrect fuel or improper use of the vehicle

The renter will be charged actual repair costs, with the following minimums:

  • Tyres: from NOK 2,000 per tyre

  • Wheels: from NOK 3,000

  • Windscreen/glass: from NOK 5,000

  • Incorrect fuel: from NOK 5,000 + documented repair costs

Loss of or damage to key

If a key is lost or damaged, the following will be charged:
Replacement key incl. programming: NOK 6,000–12,000 (depending on vehicle type)
Any recovery and transport are additional.

Flat battery / need for jump start

If jump start is required due to user error, the following will be charged:

  • Roadside call-out (daytime): NOK 2,000

  • Roadside call-out (night/weekend): from NOK 4,000

Smoking, interior damage, spills and sand

If extra cleaning is required or the interior is damaged, the following will apply:

  • Extra cleaning: NOK 2,000–4,000

  • Removal of smoke odour: from NOK 5,000

  • Interior damage: actual repair cost

6. Use of the Rental Item

Use of rental items is at the user’s own risk. All drivers must be over 18 years of age and hold a valid driving licence. The driving licence must be valid in Norway. The renter is responsible for ensuring that the equipment and accessories are used in a manner that prevents damage or abnormal wear. Correct and safe use of the equipment is the renter’s responsibility. The Lessor facilitates correct use through instructions and safety procedures available with the rental item and/or on the Lessor’s website. It is the customer’s responsibility to familiarise themselves with the Lessor’s operating and safety procedures before using the equipment.

We require the use of safety equipment. You must also follow the rental item’s instructions and other instructions from Lofoten Car Hire.

Your safety is important to us, and we encourage you to exercise caution and use appropriate safety equipment.

Approved drivers, additional driver and unauthorised driver

Only approved/registered drivers may operate the vehicle. The renter is responsible for ensuring that no unauthorised driver uses the vehicle.

If an unauthorised driver uses the vehicle, this constitutes a material breach. The Lessor may then (i) terminate the rental relationship, (ii) require the vehicle to be returned immediately, and (iii) charge the renter for incurred costs. Any additional coverage/full insurance may be void to the extent permitted under applicable rules and the relevant terms.

Prohibited use (breach)

The vehicle must not be used for:

  • driving under the influence or in violation of traffic regulations

  • racing, track use, speed competitions or any competitive driving

  • off-road/terrain driving or driving on roads/sections that may be considered unsuitable and involve an increased risk of damage/recovery

  • towing other vehicles/trailers unless expressly agreed and the vehicle is approved for it

  • transporting dangerous goods or illegal items

  • subletting, lending, or commercial passenger transport/delivery services unless agreed

  • driving outside Norway without the Lessor’s prior written consent

  • driving after warning lights/error messages indicate a risk of damage, without contacting the Lessor and receiving approval

Breach of the prohibited use provisions may result in liability for the full damage, recovery, downtime and other losses to the extent arising under general principles of tort law and insurance terms.

7. Accessories

The website describes what is included in delivery of the rental item. In addition, safety equipment is required and is offered on the website. For accessories that are sold and not used, section 12 Right of Withdrawal applies.

8. Renter’s Rights and Obligations

The renter must be at least 18 years old and provide accurate customer details when creating an account to book and rent from Lofoten Car Hire. The company sends messages to the specified email, address and phone number, and such messages are deemed received and valid upon dispatch from us.

The user account is personal, and if you suspect that others have access to your account, you must notify Lofoten Car Hire immediately. Lofoten Car Hire is entitled to reject, terminate or suspend the user account without notice or liability, including where the terms are deemed breached.

These rental terms must be accepted prior to booking on the website. The renter must return the rental item before the agreed date and time expires and in the agreed delivery method. The renter is expected to be informed of the normal opening hours of the service point.

The renter or cardholder authorises Lofoten Car Hire to create payment card instructions including for rental items that are not returned, are dirtier than normal, or are damaged. This authorisation also includes the right to charge the payment card for additional rent/compensation claims if the rental item is returned after the agreed rental period or is returned with faults or deficiencies.

Late return

The renter must return the vehicle at the agreed time and place. The return time is the absolute end time of the rental period and does not include extra time for packing, cleaning or similar.

In the event of late return, the following fees apply:

  • 0–15 minutes: NOK 500

  • 15–60 minutes: NOK 1,500

  • More than 60 minutes: charge equivalent to two additional rental days at the applicable daily rate.

In the event of further delay, the charge increases proportionally:

  • More than 24 hours: four additional rental days

  • More than 48 hours: six additional rental days
    Thereafter, the charge increases by two rental days per commenced 24-hour period.

The fee is calculated to cover operational costs, including preparation, rebooking and loss of subsequent rentals, and applies regardless of actual financial loss.

9. Changes to Booking

To change a booking, Lofoten Car Hire must be contacted. Changes are not valid until confirmed by us in writing. This ensures that the rental items are actually available. Unless otherwise agreed and confirmed, the rental item must be returned at the agreed time. Extension of the rental period may take place before the rental period starts and/or during the rental period by changing the rental start or rental end.

Changes and cancellations of rental items that affect availability for other users may incur a change fee to cover rebooking costs. The change fee is currently NOK 500. All costs will be communicated to the renter before booking or change.

Incorrect booking date / rebooking upon arrival

If the renter arrives on an incorrect date in relation to the confirmed reservation, this is considered a no-show.

Rebooking can only be offered if capacity is available, and the following fee applies:

  • Rebooking fee: NOK 1,500

Any price increase between the original and the new rental period will be charged in full to the renter.

Cancellation and no-show

Cancellation must be made in writing (email) to be valid. The following applies unless otherwise stated in the booking confirmation (campaigns/special terms may differ):

  • Cancellation more than 7 days before rental start: full refund minus an administration fee.

  • Cancellation 48 hours to 7 days before rental start: charge equivalent to 1 rental day (or 30% of the total rental amount, whichever is higher), minimum administration fee.

  • Cancellation less than 48 hours before rental start: charge equivalent to 100% of the total rental amount.

  • No-show: charge equivalent to 100% of the total rental amount.

The purpose is to cover costs and lost capacity on short notice.

10. Delivery and Return

Delivery and return take place in the manner, at the place and at the time specified in the booking confirmation. We are responsible for the products until they are taken over by you, i.e., when you have received the products in your possession. To receive the rental item you must have your booking reference. The name you provide in the reservation must match the name on the ID card at collection.

If delivery of the rental items is delayed, we will inform you as soon as we know, together with information about when delivery may take place, or if the product(s) are sold out or the rental item(s) are not available.

You are responsible for the product until it is returned to us or our service points. We inspect the rental items’ condition and function and ensure all parts are present when they arrive at our depot. Upon full return in contractual condition, the reservation of the security deposit on the payment card will be cancelled.

Documentation, post-inspection and post-charging

The Lessor documents the vehicle’s condition at both handover and return as part of a standardised inspection routine. If deviations are discovered, they will be documented and processed, including (without limitation) damage, missing items, recorded parking matters, toll passages and other matters that may provide grounds for action or charging.

Damage and missing items
Damage and missing items will be assessed. Costs may be charged to the renter and, where relevant, deducted from the security deposit in accordance with the terms.

Tolls, charges and other outlays
Outlays made on behalf of the renter, including tolls, parking fees, charges and similar, may be charged to the renter and deducted from the security deposit where applicable.

Timing of assessment and charging
For practical reasons, it may take time before a final assessment is available. Vehicles and equipment may therefore, where possible, be returned to rental use as soon as practicable before final assessment is completed.

For tolls and other outlays, there may also be a delay from when the event occurs until it is registered and information is received by the Lessor. Charging/deductions may therefore occur some time after the relevant rental period has ended.

Return outside opening hours / key drop

If return takes place outside staffed opening hours, the vehicle is deemed returned only when (i) the vehicle and key have been delivered to the agreed key drop/return point, and (ii) the Lessor has had the opportunity to carry out post-inspection. The renter remains responsible for the vehicle until that time.

The Lessor may perform final condition inspection after washing and within a reasonable time after return. Deviations discovered during post-inspection may be charged to the renter in accordance with the terms.

If forgotten items are discovered, they will be stored for up to 30 days before being disposed of or redistributed.

11. Right of Withdrawal for Purchases

The Right of Withdrawal Act gives you the right to cancel purchases. The right of withdrawal applies to goods that are purchased and not to rental items. The right of withdrawal requires that you notify us within 14 days after receiving delivery (see the Right of Withdrawal Act here: https://lovdata.no/dokument/NL/lov/2014-06-20-27).

To exercise the right of withdrawal, the product must be returned to us in approximately the same quantity and condition as you received it. If you try, use or examine the goods (open packaging, etc.) and such use/examination/testing exceeds what is necessary to establish the nature, characteristics and functioning of the product, resulting in a reduction in the product’s value, we reserve the right to deduct an amount corresponding to the reduction in value from the refundable purchase price. The product must be returned to us in original packaging and within a reasonable time together with the withdrawal form. The easiest way is to return the goods in the same box used when you received the rental item. There will be no cost to you in this case. Please complete the withdrawal form and place it in the box. If you choose to return by post or other methods, the goods are your responsibility until they reach us. You must ensure suitable packaging and contact us before sending.

Where the rules of the Right of Withdrawal Act on services apply, the provisions of the Act apply. For bookings where the rental period starts within the withdrawal period, the renter may be asked to consent to commencement in accordance with the rules of the Right of Withdrawal Act.

12. Intellectual Property Rights

The content and service are protected by copyright. The images on the website are used with permission from the rights holders. Videos on YouTube are links to third-party services beyond Lofoten Car Hire’s control.

13. Privacy

Lofoten Car Hire processes your personal data in a secure database to fulfil its obligations and protect its rights under the rental agreement. The personal data processed includes name, address, telephone number, email address and booking history. This history will be stored for accounting and other obligations. All stored information is available on “My Account”. The renter has the right to have personal data deleted from the Lessor’s systems, which can be done by contacting Lofoten Car Hire directly.

Your payment card will be stored as long as you have an active booking. Storage of the payment card takes place through our payment provider DIBS, which stores the information securely. Storing the payment card makes it easier when you shop. You may delete your payment card on your side. Lofoten Car Hire does not store any credit card details itself.

The company uses cookies, as do most online stores. Cookies store data in your browser so that the website can recognise you from page to page and from visit to visit. We can then recognise who you are so you receive correct prices and easier login. We also collect usage information to improve service quality.

Our vehicles are equipped with GPS tracking. We reserve the right to have and use this function during and after the rental period where necessary.

14. Choice of Law and Jurisdiction

These terms are governed by and shall be interpreted in accordance with Norwegian law. The agreed legal venue is Lofoten District Court.

For consumers, mandatory rights under applicable consumer protection legislation apply.

15. Amendments

Lofoten Car Hire reserves the right to amend or replace these terms at any time. The applicable terms are always available on LofotenCarHire.no. If Lofoten Car Hire considers amendments to be significant for the renter’s rights or obligations, the amendments will be made available on LofotenCarHire.no 30 days before they take effect.

Force majeure

The Lessor is not liable for delay or failure to perform due to circumstances beyond the Lessor’s reasonable control, including (without limitation) extreme weather, natural events, closed roads/airport, strikes, public orders, third-party system failures, or other unforeseen events (“force majeure”). In such cases, the Lessor may offer rebooking or another reasonable solution depending on the situation.


Appendix A – Fee Schedule (Overview)

The amounts below apply unless otherwise stated in the booking confirmation. All fees include VAT where VAT applies. Public claims (fines, certain fees, etc.) are not subject to VAT and will be charged at the actual amount.

  1. Fuel

  • Vehicle not returned with a full tank: NOK 500 + actual fuel cost

  1. Administrative fee for post-charging

  • Post-charging of tolls/parking/fees/fines/outlays – per case/event: NOK 500 + 10% of the underlying amount (excluding the administrative fee), in addition to the actual amount

  1. Changes / rebooking / cancellation

  • Change fee (change/cancellation affecting availability): NOK 500

  • Rebooking upon arrival on wrong date: NOK 1,500

  • Cancellation more than 7 days before rental start: full refund minus administration fee NOK 500

  • Cancellation 48 hours to 7 days before rental start: charge equivalent to 1 rental day or 30% of the total rental amount (whichever is higher), minimum NOK 500

  • Cancellation less than 48 hours before rental start: 100% of the total rental amount

  • No-show: 100% of the total rental amount

  1. Late return

  • 0–15 minutes: NOK 500

  • 15–60 minutes: NOK 1,500

  • More than 60 minutes: two additional rental days at the applicable daily rate

  • More than 24 hours: four additional rental days at the applicable daily rate

  • More than 48 hours: six additional rental days at the applicable daily rate

  • Thereafter: two additional rental days per commenced 24-hour period

  1. Roadside assistance / jump start (user error)

  • Roadside call-out (daytime): NOK 2,000

  • Roadside call-out (night/weekend): from NOK 4,000

  1. Tyres / wheels / glass / incorrect fuel (minimums)

  • Tyres: from NOK 2,000 per tyre

  • Wheels: from NOK 3,000

  • Windscreen/glass: from NOK 5,000

  • Incorrect fuel: from NOK 5,000 + documented repair costs

  1. Keys

  • Replacement key incl. programming: NOK 6,000–12,000 (depending on vehicle type)

  • Any recovery and transport are additional

  1. Cleaning / interior

  • Extra cleaning: NOK 2,000–4,000

  • Removal of smoke odour: from NOK 5,000

  • Interior damage: actual repair cost

  1. Full insurance

  • Full insurance (reduction of excess): NOK 750 per day per vehicle
